MONTEREY, Monterey County — October 22, 2026. Owners thinking about advertising a home or apartment for stays shorter than 30 days should not assume that payment of occupancy tax makes the activity legal. The City of Monterey’s published lodging tax FAQ says short-term rentals are restricted by where the property is zoned.

What does Monterey say about short stays?

The city’s official Transient Occupancy Tax FAQ, updated July 1, 2025, states that rentals of fewer than 30 days are not permitted in areas other than those zoned for Visitor Accommodation Facilities (VAF). It expressly mentions short-term rentals marketed through platforms such as Airbnb and VRBO. Because a tax FAQ is only one document, owners should confirm the current municipal zoning rules and any later amendments directly with the city before acting in 2026.

Does paying hotel tax authorize a rental?

No. The city differentiates its tax rules from restrictions on where vacation rentals may operate. The same FAQ says a person operating a short-term rental is required to collect and remit applicable transient occupancy tax by its stated due date. Tax liability can exist without municipal permission to operate in a prohibited zone. An online platform’s willingness to accept a listing is also not a zoning approval.

What exactly is a VAF?

The FAQ quotes Monterey’s municipal code definition of Visitor Accommodation Facilities as structures used or intended for transient lodging of 30 days or less. The definition includes various accommodation types. A broad tax definition does not mean every listed housing type is allowed on every residential parcel.

Check the address before promising income

  1. Confirm the property’s legal jurisdiction and zoning designation.
  2. Ask the City of Monterey whether short-term lodging is a permitted use at that address.
  3. Request the currently applicable business, lodging, building and fire requirements.
  4. Review potential association or lease restrictions separately.
  5. Verify current tax collection, filing and payment obligations with the city’s Finance Department.

The city’s FAQ identifies the Monterey Finance Department at 831-646-3944 and revenue@monterey.gov for tax questions. For zoning and permits, consult the relevant planning staff rather than assuming Finance staff issue land-use permissions.

And what about conventional rental housing?

Longer-term rentals are a different subject. Monterey has a separate rental inventory program. Its 2025 Rental Inventory FAQ explains registration information and exemptions. Do not confuse a rental-inventory filing with a short-term-vacation-rental entitlement.
